Car Insurance Claims Maine ME

Reader’s Question:

If I do not get into an accident for a long period of time in Maine, will the insurance company refund some of the premium that I have paid for all those years?

Lisa

Portland, ME

This is not an option on car insurance policies, although there are insurance products that have accumulated cash value, like life insurance. Car insurance does not work like other financial services that we normally pay for. Car insurance is something you buy hoping you never have to use it, and you buy it to protect yourself from losses that you cannot afford. Originally, it was mainly purchased to cover unexpected losses, but over time it has become very common for all drivers to expect to use their car insurance policy.

Car insurance is about spreading out the risk among everyone who purchases car insurance in Maine like in any other states. Car insurance premium goes to help fund losses suffered by the entire group or policyholders. The premium you pay is calculated based upon statistics that it will get used. If this wasn’t the reality then premiums would be higher, or simply you would pay for each claim in its entirety. Your car insurance company works (for themselves and their policyholders) to minimize the amount of risk it takes. It used to be said that the lower the premium, the less a company pays out on claims. But with better systems, companies are able to lower costs for consumers. Buying a car insurance policy online is another example of how companies work to save you money.

Believe it or not, insurance isn’t as profitable as most financial products. A lot of car insurance companies write insurance, particularly homeowners insurance on a loss and make money only on their investment income. This is one reason it is important to understand if your insurance company is rated.

Reader’s Question:

Is Maine state laws on insurance and registration dependent on each other? If there are insurance lapses, would that automatically mean the vehicle registration is revoked? Do insurance companies in Portland report insurance lapses to the state of ME?

Zoe

Portland, ME

Yes. Maine’s Bureau of Motor Vehicles (BMV) requires insurance companies to inform them of a car owner’s insurance lapse or cancellation. The car owner must be able to provide a proof of active insurance in order to prevent the revocation of his vehicle registration. Also, a law called the electronic Notification of Insurance Cancellation Program took effect in January 1, 2005 requiring insurance companies in ME to report the cancellation/termination of mandatory liability insurance coverage on vehicles.

The Bureau of Motor Vehicles (BMV) will send a notice to the owners of vehicles with lapsed/canceled insurance indicating that their registration will be suspended if they do not provide a proof of an active insurance coverage. Car owners are given 30 days from the date of notification from BMV or otherwise registrations will be suspended if evidence of insurance is not provided.

After receiving the notification letter from ME BMV, you must provide evidence of active insurance before the effective suspension date listed at the beginning of that letter. You can send this proof online, by mail, by fax or in person at a BMV location.

Auto Insurance Rate Portland Maine ME

Reader’s Question:

I received a speeding ticket in Portland Maine but I have a NY State license. Someone told me that I will not get a deduction in points for my license, is this correct? What about my car insurance? Will it go up?

Naomi

Portland, ME

New York and Maine are both members of the Drivers License Compact (DLC) so the Maine traffic court or ME Bureau of Motor Vehicles will notify the NY State Department of Motor Vehicles that you have received speeding ticket.

The New York DMV though has decided not to record out of state infractions unless from Ontario or Quebec. The Department of Motor Vehicle also does not add points to your driving record for out of state moving violations.

Since the Portland Maine speeding violation is not being placed on your NYS driving record or being assigned points it is unlikely that your insurance provider would see this out of state ticket but not impossible. If they are notified of the ME speeding ticket then it would depend upon your insurance carrier’s rating system if your car insurance rates would go up or not. You can verify about your insurance company’s rating system from your insurance agent or the New York Department of Insurance with whom rates must be filed with.

Portland ME Car Insurance Rate

Reader’s Question:

Will my insurance rate go up if I don’t pay my car insurance premium this month, and allow it to get it cancelled, and then change car insurance carrier next month?

Julia

Portland, ME

Yes, it is possible that your insurance rates would go up if you allowed your current car insurance policy to get cancelled for non-payment and a month later decided to obtain car insurance with a new insurer.

A new insurance company may be wary to take your business if they would see that you have previously not paid fully on your insurance policy and allowed it to cancel for nonpayment. Being more of a risk in this way could cause an insurance company to not either want to accept your business or will make your insurance rate higher.

If you no longer want car insurance through your current insurance company then you should notify them and terminate your policy. But before doing so you will want to get a new auto insurance policy to cover your vehicle so that there will not be a lapse in coverage.

Reader’s Question:

My wife had an accident with his employer’s vehicle about three years ago and the employers insurance paid for it all in Maine. When we sign up for new personal auto insurance do we have to inform them about the accident in his employer’s vehicle?

Kris

Portland, ME

Though the claim for your wife’s accident in his employer’s or company vehicle in Maine was paid by the employer’s insurance, the accident itself is likely on your wife’s driving history. So while the claim for the accident may not affect your personal car insurance, the accident being on your wife’s motor vehicle record may.

If the personal car insurance provider requests information on accidents and moving infractions that have happened in the past it is best to be as honest and upfront as possible.

When filling out a car insurance application or renewal information form it is best to give as accurate information as possible. So when applying for auto insurance if you or your wife are asked if you have been involved in an accident in the past five years you should in list this accident.

Reader’s Question:

What are the state laws in Maine on insurance of a vehicle? If insurance lapses will my vehicle registration be suspended in Portland ME? Do insurance providers actually report to the state of Maine if insurance is lapsed?

Beth

Portland, ME

A individual may not register a vehicle in Maine unless the individual satisfies the Secretary of State that the car is covered by a liability insurance policy. Violation of this section of the law is a traffic violation, for which a forfeiture of not less than $100 and not more than $500.

A car owner is mandated to have the State minimum liability coverage of $50,000/$100,000/$25,000 in Maine.

Yes, in Maine insurance providers are required to notify the ME Bureau of Motor Vehicles (BMV) when an individual’s insurance has lapsed, cancelled or otherwise has been terminated. If this has been done you must show proof of active insurance to avoid suspension of your driving privilege. Without this the auto owner’s registration certificate and plates for the uninsured car will be suspended.

Reader’s Question:

What is the penalty in the state of Maine for driving without insurance and registration?

Amy

Portland, ME

The penalties for driving without insurance and registration in the state of Maine are quite severe. A registration that is expired will get you a summons and warning. If the vehicle has not been registered at all or within the last 150 days and you are stopped by a police officer it will be considered a Class E crime. In Maine a Class E crime can permit you to be arrested and go before a district court judge. Class E offense is six months if found guilty.

In Maine, being convicted of driving without insurance is a traffic violation (and also a Class E crime) for which a fine of not less than $100 and not more than $500 may be assessed. Your vehicle and license registration can also be suspended. The suspension will go on until financial responsibility is proven and there are other requirements that might be compulsory. You might then have a restricted license for a time period of time also.

Q: What kind of features should I get on my new car to save money on my Lewiston SR22 policy?

A: There are two big money saving categories in the features department which may cost you a little extra at the car lot but which, in the long run, which will both protect you and your wallet, at least when regarding car insurance. Those categories are anti theft devices and safety features.

For an anti theft device, if you want a discount on your Lewiston SR22 policy, then you need to first of all have a device which will disable your car when a thief tries to break in. This is best in the form of something which will disable the engine, because wheel locks which disable the wheel, or locks which disable the tires are easier to break through. You also need an anti theft device which activates itself automatically when you turn off your car.

As for safety, the most important things you can have are air bags, anti lock breaks, and an electronic stability system. Side curtain air bags are great, and most car insurance companies will give you discounts for the breaks, and many are beginning to for the stability system.
